ARTICLE 1: Purpose
The purpose of these terms of sale is to set the rights and obligations of the parties as they apply to the sale of goods by the http:www.latabledarc.com , ARC DECORATION to the purchaser.

ARTICLE 2: Duration
These terms of sale come into force on the date the purchaser signs the purchase order.
ARTICLE 3: The prices of items
Our product prices are stated in euros, including all applicable taxes and not including shipping and handling fees, which are invoiced in addition to the prices of the items ordered. In the event of orders shipped to countries other than metropolitan France, the purchaser is understood to be importing the product or products concerned.
ARC DECORATION reserves the right to change its prices at any time. However, products will be invoiced based on the prices in effect at the time the order is recorded, subject to availability. Products sold shall remain the sole and complete property of ARC DECORATION until all amounts due relative to the order are received from the purchaser, including fees and taxes.
ARTICLE 4: Where and how to place an order?
Please complete your order on line carefully in order to ensure that your items are received correctly.
- On the Internet : Fill in the electronic purchase order form as completely as possible. Include your first name, last name, address, delivery address if different, postal code, city, country, telephone number, e-mail address, product description, product reference code (very important), colour and size if necessary and the quantity ordered.
In addition, if the information provided by the purchaser at the time of the order is not complete and accurate, ARC DECORATION shall not be held liable for any order entry errors and the resulting consequences, particularly in terms of delivery delays and errors.
Recommendation: ARC DECORATION recommends that purchasers keep copies of all information relative to their orders on paper or a reliable computer format until the order has been completely resolved or until the end of the guarantee period for the products delivered.
ARTICLE 5: Payment methods
- Credit card : Don't forget to include your credit card number, credit card security code, expiration date.
The following cards are accepted: CB, Visa, Mastercard.
ARTICLE 6: Confirmation of orders
For Internet orders, when the purchaser clicks on the “Submit order” button at the end of the ordering process, it is understood that the purchaser accepts fully and unreservedly the order as well as all of the provisions of these Terms of Sale.
The automatic order recording systems are considered proof of the nature, content and date of the order. The sale will not be completed until the order is confirmed. Data recorded by http:www.latabledarc.com when orders are submitted are considered proof of all transactions completed between ARC DECORATION and the purchaser. The data recorded by the ARC DECORATION payment system is considered proof of the financial transactions completed.
ARC DECORATION reserves the right to cancel orders from customers with whom there is a dispute concerning the payment of a previous order. The information provided by the purchaser at the time of the order is binding in the event of errors concerning the contact information of the order recipient or in the description of the items ordered (incorrect product reference codes, etc.).
ARTICLE 7: Deliveries
Delivery of the item or items ordered is made to the purchaser’s home address within 10 days from the date the order was duly submitted for deliveries to addresses in metropolitan France and within 2 weeks for the European Union countries.
The delivery times provided are average delivery times, subject to the availability of the items ordered in stock.
In the event of different delivery dates within the same order due to the unavailability of an item, the delivery date given will be the latest.
However, ARC DECORATION reserves the right to make separate shipments. In such cases, shipping and handling fees will only be charged for a single shipment.
ARC DECORATION works with the French Post Office (“La Poste”) “Colissimo” service for deliveries to addresses in metropolitan France and also the UPS company for deliveries to addresses in countries within European Union.
Under no circumstances shall the ARC DECORATION be held liable for the failure of the French Post office to provide postal services.
– Availability of items in stock
The items presented will only be delivered if they are in stock. Information concerning the availability of products is provided by the product suppliers and/or manufacturers.
As such, ARC DECORATION shall not be held liable in the event that an item is permanently discontinued or temporarily unavailable for shipment nor shall such instances result in the payment of compensation for damages to the purchaser.
Out-of-stock items
ARC DECORATION agrees to inform the purchaser, if necessary, by the means of its choice (telephone, fax, e-mail, regular mail) of any stock shortages affecting the purchaser’s order or orders. In such instances, the seller shall provide the purchaser with a revised approximate delivery date (the revised date must be provided prior to the original delivery date) and must also inform the purchaser that, if the revised date is not accepted, the purchaser may cancel the order and obtain a full refund.
Default of suppliers
Furthermore, ARC DECORATION reserves the right to cancel all or part of an order or orders placed by the purchaser in the event that ARC DECORATION suppliers fail to provide the items concerned or in the event of force majeure as defined by jurisprudence and French law.
– Delivery methods
Place and date of delivery
Delivery of the item or items ordered is made to the purchaser’s home address within 10 days from the date the order was duly submitted for deliveries to addresses in metropolitan France and within 2 weeks for the European Union countries.
ARC DECORATION processes orders as quickly as possible. However, if the aforementioned delivery times cannot be adhered to, the purchaser must be informed by ARC DECORATION or its service providers by the means of their choice
The purchaser may then choose to pursue the order, cancel the order, or receive a full refund for the order.
As an outside service provider is used for the shipment of orders, ARC DECORATION agrees to do everything possible to encourage the service provider to adhere to the delivery times set.
Risk and fees
All delivery fees shall be paid by the purchaser. If the package is delivered open and/or damaged and if the purchaser accepts it upon delivery with “hand-written reservations”, the purchaser must have the delivery person or post office draw up an “anomaly report”.
This report must then be sent to ARC DECORATION so that an investigation can be carried out and compensation paid, if necessary.
If the purchaser refuses the merchandise delivered, in addition to the “hand-written reservations” the purchaser must request that the post office return the package to ARC DECORATION with a “damage report”. The purchaser must also keep a copy of this report if necessary.
Any claim on delivery will be done to the Customer Service Department until 15 days after the dispatch. The Customer Service Department is available during French working hours by regular mail and e-mail:

ARTICLE 8: Money-back guarantee
8.1 – Returns and withdrawals
8.1 1 Returns
Internet transactions are considered mail-order sales according to Articles L121-16 and following of the French Consumer Code. As such, the purchaser of an item presented by ARC DECORATION has seven (7) working days from the date the item is received to return the product, with no penalties other than the cost of shipping the merchandise, and without providing a reason.

8.1.2. Other conditions
In order to exercise the right of withdrawal, the purchaser must return the product in new condition in the original packaging within the time set above. Any product that is withdrawn by the purchaser must be returned to ARC DECORATION in new, re-sellable condition. Exchanges or refunds will not be granted for any product that is damaged, that is missing parts, or for which the original packaging has been damaged or removed.
The purchaser must pay return shipping fees and returns are at the purchaser’s risk. The purchaser may return all or a part of the order.
8.1.3. Exceptions
The right of withdrawal does not apply to products manufactured to the purchaser's specifications or to products that have been personalised.
8.2 – Exchanges and refunds
8.2.1. Options available to the purchaser
If the purchaser chooses to exercise the right of withdrawal granted by the French Consumer Code and set above, he may opt to exchange the item or items being returned or receive a full refund. Whether the purchaser chooses an exchange or refund, the request will not be processed until the products concerned are received by ARC DECORATION. In any event, only the price of the product or products returned will be refunded.
Refunds will be paid at the discretion of ARC DECORATION, either by crediting the credit card the purchaser used for the order, or by cheque made out to the purchaser and sent to the billing address on the order.
8.2.2. Deadline for payment of refunds
In the event that the purchaser chooses to exercise the right of withdrawal, ARC DECORATION will do everything possible to ensure that the purchaser receives a refund within two weeks of the date the merchandise returned is received by ARC DECORATION or service provider.
ARTICLE 9: Currency
All orders, regardless of where they originate, must be paid in euros.
ARTICLE 10: Guarantee concerning concealed defects
As the transactions covered by these Terms of Sale are considered sales, ARC DECORATION must, in compliance with Article 1641 of the French Civil Code, provide the legally-mandated guarantee that requires professional sellers to protect consumers from any consequences resulting from concealed defects of the item sold. This clause is only applicable if the order has been paid in full.
ARTICLE 11: Quality
11.1 – Counterfeit merchandise
ARC DECORATION works with suppliers to ensure that all products sold comply with French legal provisions and regulations concerning counterfeit merchandise.
11.2 – Social responsibility
The ARC DECORATION works with suppliers to ensure that all products sold are manufactured by workers employed under conditions that comply with the labour legislation in the countries concerned.
11.3 – Product safety
ARC DECORATIONagrees to work with suppliers to ensure that all products sold comply with the safety standards and regulations in effect.
ARTICLE 12: Use of personal information
12.1 - Protection of personal information
12.1.1 Right of access and opposition
ARC DECORATION reserves the right to gather personal information. The personal information provided by the purchaser or gathered during use of the Web site (via cookies or ActiveX) is used to ensure that deliveries are made, to improve the quality of service and to more effectively meet the needs of the purchaser.
The purchaser agrees to allow ARC DECORATION to use this personal information, in particular for the purpose of informing the purchaser about products and special offers that may be of interest to him by telephone, e-mail, or regular mail.
In compliance with the provisions of the Data Privacy Law of 6 January 1978, the client has the right to access and correct personal information that concerns him. 12.1.2. Protection system
The seller agrees to take all possible measures to ensure the security of this personal information. For example, in compliance with Article 29 of French law no. 78-17 of 6 January 1978 relative to data privacy the seller agrees to ensure that the on-line gathering of bank account information for the purpose of completing commercial transactions concerning physical or digital products sold by the http:www.latabledarc.com is carried out via effective, legal secure payment processes designed to prevent unauthorised third parties from intercepting, accessing, modifying, or using said information for their own benefit.
Information relative to the purchaser is kept confidential by ARC DECORATION for two years from the purchaser’s most recent visit to the Web site. The purchaser is informed that the automated processing of this information has been reported to the CNIL (French Commission on Data Privacy)
12.1.3. Exclusive liability clause
However, while ARC DECORATION agrees to act with the care and diligence required to ensure the security and to protect the confidential nature of the data gathered via the Web site, it shall not be held liable for any tampering with the site despite the precautions taken and with regard to any negative consequences that may result from such tampering and, in particular, the use of confidential information such as bank account information concerning the purchasers who use the site.
12.2. - Transmission of personal information
12.2.1. The seller’s obligations
The seller agrees to inform the purchaser about the possibility that personal information concerning the purchaser may be shared with persons authorised to access the information-gathering systems.
12.2.2. The purchaser’s rights

13.2 Customer relations
All requests for information are answered, regardless of the means of submission. For each response, the name of the person who handled the claim or dispute is provided. Furthermore, ARC DECORATION agrees to telephone or write to the purchaser even if no immediate solution to the claim submitted has been found.
