1. Preamble
This site (hereinafter referred to as "Site") is the property of the company Arc Web & Retail, which holds, in particular, all intellectual property rights relating thereto.
Any reproduction, in whole or in part, of the Site is prohibited without the express prior authorization of Arc Web & Retail.
These general terms and conditions of sale (hereinafter referred to as "GTC") are concluded between, on the one hand, the company Arc Web & Retail, registered in the Trade and Companies Register of Boulogne sur Mer under number 483 855 227 and located in Arques, 62510, 104 avenue du général de Gaulle, hereinafter referred to as "Arc Web & Retail" and, on the other hand, the persons wishing to make a purchase via the Site hereinafter referred to as "the User" or the "Customer".
Packages can be shipped to mainland France and to all of the countries listed below: Germany, Austria, Belgium, Spain, France, Ireland, Italy, Luxembourg, Netherlands, Portugal
These T&Cs apply to any natural person who acts for purposes that do not fall within the scope of their commercial, industrial, craft or liberal activity.
2. Acceptance of the conditions
The Customer acknowledges having read these General Terms and Conditions at the time of placing their order and expressly declares that they accept them without reservation. Placing an order through this Site implies unreserved acceptance of these General Terms and Conditions. Arc Web & Retail reserves the right to adapt or modify these General Terms and Conditions at any time. In the event of modification, the general terms and conditions of sale in force on the day the order is placed will apply.
3. Illustration
These General Terms and Conditions govern the contractual relationship between Arc Web & Retail and its Client and prevail over all other conditions. The presentation and photographs of the products on the Site are for illustrative purposes only. The Client is required to refer to the description of each Product in order to understand its essential properties and characteristics.
4. Order
In order to place an order, the Customer must log in to their customer account, or failing that, create an account.
Any order implies acceptance of the prices and description of the items available for sale.
Items are sold while stocks last. Any item temporarily unavailable will be specified to the Customer on the product sheet, which they will have access to before placing an order. However, the sale will only be final once the order has been confirmed by Arc Web & Retail via the email address provided by the Customer.
The information provided by the Customer when placing an order is binding on the Customer. Therefore, in the event of an error, particularly in the wording of the Customer's contact details, Arc Web & Retail cannot be held responsible for the impossibility of delivering the order.
Arc Web & Retail reserves the right to cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order, subject to prior notification from this Customer.
5. Promotions
All products that are the subject of a promotion are offered while stocks last. Therefore, if a Product is out of stock during the promotion period, the Customer will not be able to request restocking at the promotional price displayed.
6. Price
The price is expressed in euros. Arc Web & Retail reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the Site on the day the order is placed will be the only price applicable to the Customer.
The price indicated on the product sheets does not include shipping costs. For deliveries outside mainland France, the Customer agrees to pay, in addition to the price of the Product, all taxes due on the importation of the items, customs duty, value added tax, and all other taxes due under the laws of the country where the order is received. Arc Web & Retail therefore disclaims any legal liability if the Customer does not pay the taxes.
The price indicated at the time of finalizing the order is the final price, expressed inclusive of all taxes and including VAT for France and the countries of the European Union. This invoiced price includes the price of the products, handling, packaging and storage costs as well as transport costs.
7. Payment
The price charged to the Customer is the price indicated at the time of finalizing the order and in the order confirmation email sent by Arc Web & Retail.
The price of the products is payable in cash on the day of the order using various payment methods.

Payment security
To ensure payment security, Arc Web & Retail uses the Webaffaires secure payment service, which allows customers to pay via a secure banking server. The bank card number is then directed to the bank's servers, and payment is made directly to a bank in a secure environment.
Actual payment
The order validated by the Customer will only be considered effective once the relevant bank payment centers have given their approval. In the event of refusal by the said centers, the order will be automatically canceled and the Customer will be notified by email.
Any order confirmation will be notified to the Customer after payment validation. In the event of payment refusal, the Customer will also be notified, along with the reason for refusal.
8. Delivery
Delivery times depend on the country of delivery and the delivery method chosen by the Customer. The Customer is invited to consult the Delivery and Shipping Costs tab for an estimate of delivery times. These times are purely indicative and cannot be binding on Arc Web & Retail. The Customer will be informed of the delivery date and/or time at the time of placing the order, which will then be confirmed by email once the order has been placed.
Depending on the delivery method chosen, delivery will be carried out by one of the following transport providers (hereinafter the "Carrier"):
- Colissimo
- Chronopost
- DB Schenker
For home deliveries and in case of absence, the Carrier will notify the nearest post office of its visit and the availability of the package or will schedule a new delivery date.
For any order weighing more than 30 kilograms, destined for mainland France or abroad, the said goods will be transported by pallet and the delivery will be carried out by the delivery organization DB Schenker, or any other organization designated by Arc Web & Retail to replace it. Upon validation of the order, the Arc Web & Retail Consumer Service will contact the Customer to define with him a delivery day at his convenience. The delivery slot is fixed between 8 a.m. and 6 p.m., Monday to Friday, and can in no case be adapted to the needs of the Customer. In the event of the absence of the Customer at the time of delivery, the Carrier will notify his passage and will communicate his contact information in order to fix a new delivery appointment.
In the event of a delay compared to the announced delivery time, except in cases of force majeure* of which the customer is informed, the Customer may request AWR to make the delivery within a reasonable additional time by registered letter with acknowledgment of receipt. Following this request and without compliance with the new deadline, the Customer is entitled to cancel his order by sending a registered letter with acknowledgment of receipt to AWR, in accordance with Article L.216-2 of the Consumer Code.
*Force majeure includes, in particular, war, riots, fire, strikes, accidents, inability to obtain supplies, epidemics, quarantine measures or similar restrictions.
Ownership and risk of damage to the products are transferred to the Customer when the latter takes physical possession of the goods. The Customer is therefore advised to always check the package upon receipt. The Customer has 48 hours to make any reservations to the carrier in the event of damage to the package. If the Customer accepts a delivery and it subsequently turns out that there is a breakage or defect in the delivered Product, the Customer is invited to contact Arc Web & Retail customer service within 48 hours of delivery to notify them in writing of the problem.

In the event of apparent defects in the products at the time of delivery, the Customer benefits from the guarantees and the right of return under the conditions provided for in these General Terms and Conditions.
Due to availability, an order may be delivered to the Customer in multiple installments. The Customer then pays for only one delivery. If the Customer requests delivery to two locations, they place two orders, with the associated delivery costs.

9. Withdrawal
The Customer has 14 days from receipt of the items to exercise their right of withdrawal and return the Products. The Customer may not waive this right in any way. The Customer, wishing to exercise their right of withdrawal, has the form within their package or on the Site and must return the new Product(s) in their original packaging, intact, accompanied by all possible accessories, instructions for use and documentation, proof of purchase to the following address:

The cost of returning the item is the responsibility of the Customer.
In the event of exercising the right of withdrawal, Arc Web & Retail is required to reimburse the sums paid by the Customer, including delivery costs (with the exception of return costs). However, these delivery costs are not reimbursed in the event of partial withdrawal, i.e. in the event of the return of only part of the items in the same order.
Reimbursement is due within a maximum of 14 days from the exercise of the right of withdrawal.
10. Guarantees
Any item sold by Arc Web & Retail to a non-professional buyer benefits, in accordance with current French legal provisions and independent of the right of withdrawal referred to above:
- the legal guarantee of conformity
- as well as the legal guarantee against hidden defects.
The liability of Arc Web & Retail is limited to the value of the Products in question, value on the date of sale.

Refunds for products deemed non-compliant or defective will be made as soon as possible and at the latest within 14 days following Arc Web & Retail's discovery of the lack of conformity or hidden defect.
10.1 - Legal guarantee of conformity (Art. L217-4 et seq. of the Consumer Code).
Article L217-4 of the Consumer Code "The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been made his responsibility by the contract or has been carried out under his responsibility."
Article L217-5 of the Consumer Code: “The good is in conformity with the contract: 1° if it is suitable for the use usually expected of a similar good and, where applicable: - if it corresponds to the description given by the seller and has the qualities that the latter has presented to the buyer in the form of a sample or model; - if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling; 2° Or if it has the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.”
Article L217-12 of the Consumer Code “The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.”
Article L217-16 of the Consumer Code. “When the buyer requests from the seller, during the course of the commercial guarantee granted to him upon the acquisition or repair of a movable good, a repair covered by the guarantee, any period of immobilization of at least seven days is added to the duration of the guarantee which remained to run. This period runs from the request for intervention by the buyer or from the provision for repair of the good in question, if this provision is subsequent to the request for intervention.”
Arc Web & Retail undertakes to deliver Products that comply with those ordered. Failing this, Arc Web & Retail is responsible for defects during delivery as well as those resulting from the packaging.
The item sold is deemed to be compliant when it is either:
- Suitable for the use usually expected of a similar article, namely, where applicable:
- that it corresponds to the seller's description and has the qualities presented in the sample or model
- that it presents the qualities that a consumer can legitimately expect following the public statements of the seller, producer or representative (advertising, labeling, etc.). The statements of these last two professionals do not bind the seller when the latter does not know them and is not in a legitimate position to know them.
- Has the characteristics defined by the parties or is suitable for the special use sought by the Customer, known to the seller and accepted. The Customer cannot invoke the guarantee of conformity according to article L.217-8 of the Consumer Code in the following cases: (i) when he was aware of the defect at the time of contracting, (ii) when he could not be unaware of the defect at the time of contracting or (iii) when the defect results from materials that he himself supplied.
Time limit:
The action for the guarantee of conformity is prescribed by two (2) years from the delivery of the article (proof of delivery being authentic). However, any defect appearing within six (6) months of delivery will be deemed to exist on the day of delivery. The Customer will therefore be exempt from providing proof.
Implementation of the conformity guarantee:
When there is a lack of conformity, Arc Web & Retail offers the Customer the replacement of the item or its repair. The choice is up to the Customer, except when it generates disproportionate costs for the professional compared to the second method. The Customer may obtain the termination of the contract or a price reduction if the defect is major and the time limit for the chosen solution exceeds one (1) month from the request; or if no other method is feasible. No fees may be charged to the Customer for the replacement, repair, termination or reduction of the contract.
When there is a lack of conformity, Arc Web & Retail offers the Customer the replacement of the item or its repair. The choice is up to the Customer, except when it generates disproportionate costs for the professional compared to the second method. The Customer may obtain the termination of the contract or a price reduction if the defect is major and the time limit for the chosen solution exceeds one (1) month from the request; or if no other method is feasible. No fees may be charged to the Customer for the replacement, repair, termination or reduction of the contract.
10.2 - Legal guarantee against hidden defects (Art. 1641 et seq. of the Civil Code)
Article 1641 of the Civil Code “The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.”
Article 1648 of the Civil Code: "The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect. In the case provided for in Article 1642-1, the action must be brought, under penalty of foreclosure, within one year following the date on which the seller can be discharged from apparent defects or lack of conformity."
Arc Web & Retail is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the Customer would not have purchased it, or would have paid a lower price for it, if he had known of them.
The legal warranty covers all costs incurred due to hidden defects. Arc Web & Retail is not liable for visible defects that the Customer has been able to verify themselves, but for hidden defects, even if they were not known to them, unless, in this case, they have stipulated that they will not be obliged to provide any warranty. The defect must predate the sale and render the products unfit for the use for which they are intended.
The Customer has the choice between returning the item and receiving a refund or keeping the item and receiving a partial refund.
The time limit for action is two (2) years from the discovery of the defect.
11. Responsibilities
Arc Web & Retail cannot be held liable for damages of any kind that may result from malfunction or misuse of the items sold. Arc Web & Retail's liability will, in any event, be limited to the amount of the order and cannot be held liable for simple errors or omissions that may have persisted despite all the precautions taken in the presentation of the items.
12. Protection of personal data
The provision of personal information collected for the purposes of distance selling is mandatory, as this information is essential for processing and delivering orders, and for issuing invoices and guarantees. Failure to provide this information will prevent the order from being validated.
In accordance with the provisions of the Data Protection Act of 6 January 1978, as amended, and Regulation (EU) No. 2016/679 of 27 April 2016, the Client has the right to access, oppose, modify, rectify and delete data concerning him/her and the right to define guidelines regarding the fate of his/her personal data if he/she can no longer exercise them. 13. Intellectual Property
Use of this Site is reserved for strictly personal use.
All trademarks, texts, comments, works, illustrations, images or photographs, whether visual or audio, relating to the seller or its articles reproduced on the Site are protected under copyright, trademark law, patent law and/or image rights. They are the property of Arc Web & Retail or its affiliated companies. Any reproduction or representation, in whole or in part, constitutes an infringement which may incur the civil and criminal liability of its author.
Any person outside the ARC group may, without prior authorization, place a hyperlink to this Site using the technique known as framing or deep linking. A specific request is required for hyperlinks to the Site to be authorized.
14. Compliance with economic sanctions - Anti-corruption
The sale of goods and services (hereinafter "Products") by the company Arc Web & Retail via the Site is subject to compliance by the Customer with all anti-corruption laws and regulations as well as those relating to export control and economic sanctions, including in particular, but not limited to, sanctions imposed by the UN, the European Union and the United States of America, as well as any relevant national legislation (hereinafter the "Laws") relating to the use, sale, transfer and/or maintenance of the Products.
By purchasing the Products, the Customer declares, guarantees and ensures:
- that it has complied and will comply with all Laws applicable to the Products and, in particular but not exclusively, that the Customer has not sold and will not sell, resell or otherwise transfer the Products, directly or indirectly, for delivery to or through Iran, Syria, Sudan, North Korea, Cuba, the Crimea region, Luhansk, Donetsk, Zaporizhia and Kherson of Ukraine/Russia or for any carriage, distribution or use by any named person, entity or vessel subject to Laws relating to Iran, Syria, Sudan, North Korea, Cuba and/or the Crimea region, Luhansk, Donetsk, Zaporizhia and Kherson of Ukraine/Russia (including individuals or entities who are residents or domiciled therein, or who are incorporated under the laws of such jurisdictions)
- that it is not and will not be considered a prohibited party on any of the lists adopted and administered by the Laws, including the Specially Designated Persons List (SDN List), the Foreign Sanctions Evaders List (FSE List), the Sector-Specific Sanctions List (SSI List), the EU Consolidated List of Financially Restricted Persons, Groups and Entities and/or the United Nations Security Council Consolidated List of Sanctioned Entities; and
- that it is not and will not become an entity controlled by or acting on behalf of one or more persons identified in (i) or (ii) or in which one or more persons identified in (i) or (ii) hold, directly or indirectly, an interest of 50% or more, individually or collectively.
The Client undertakes to immediately notify Arc Web & Retail of any breach.
15. Applicable law and jurisdiction
These conditions are subject to French law.
The Customer is informed of the possibility of resorting, in the event of a dispute, to a conventional mediation procedure in application of Title V of Book 1 of the Consumer Code.

After a prior written approach by the Customer to the Company's Customer Service, the mediator service may be contacted for any consumer dispute that has not been resolved. To find out how to contact the mediator, click here .
The Customer may also submit any complaints on the dispute resolution platform set up online by the European Commission at the following address: http://ec.europa.eu/consumers/odr/ . The European Commission will transfer the Customer's complaint to the competent national mediators notified.
The competent court in the event of a dispute will be at the Client's choice.
- either one of the courts with territorial jurisdiction under the Code of Civil Procedure
- either the jurisdiction of the place where he resided at the time of the conclusion of the contract or the occurrence of the harmful event.
